It’s hard to write any news today, Friday, without paying heed to yesterday’s slap in the face to gay men and women across New York State by the court. In a messy, fractured decision, the court said that the State’s constitution does not require equal rights for gay men and women.
“We hold that the New York Constitution does not compel recognition of marriages between members of the same sex,” said Judge Robert S. Smith. “Whether such marriages should be recognized is a question to be addressed by the Legislature.”
The decision was fractured, resulting in several opinions, but the conclusion was still in the negative. The court also said that because the current law also bans straight people of the same gender from marrying, then the current situation is not discrimination.
Huh? We here at OUTzone don't know of any straight people that want to marry partners of the same gender. Does the court know of some polyamorous sect we don't know about!?
And let’s not even get into the argument Smith put forth that repeats outdated and unproven contentions that kids are better off raised by a mother and a father. We all know that’s not true.
